What does California require of an online checkout?

How should subscriptions be set up for California customers?

To the strictest standard, since it then satisfies everywhere else. California's Automatic Renewal Law requires the terms of a subscription to be presented clearly and conspicuously before the customer agrees, the customer's affirmative consent to those terms, an acknowledgment afterwards that includes how to cancel, and a way to cancel online for anyone who signed up online.

Free trials and introductory prices need a reminder before they convert to the full price. A store may make one retention offer when someone goes to cancel, but it cannot bury the cancel button or require a phone call.

When does a store need Proposition 65 warnings?

When a product can expose Californians to a chemical on the state's list of substances known to cause cancer or reproductive harm, above the safe harbor levels. The list is long and covers substances found in some ceramics, jewelry, furniture, electronics, supplements, cosmetics, vinyl and many other everyday goods.

For online sales, the warning generally has to be given before the purchase is completed, for example on the product page or during checkout, and not only on the package that arrives afterwards. Private enforcers actively look for stores that omit it.

Deciding which products need a warning is a matter for your suppliers, testing and legal counsel. Our part is to make the store capable of displaying the right warning for the right product: a field in the catalog, wording in the approved format, and placement on the product page and in the cart for orders shipping to California.

How do you sell to customers across the border?

Some items cannot be sent by military mail because of size or content restrictions, and the store should say so on the product page.
